Important change in insurance law for the state of GA regarding Uninsured/ Underinsured Motorist: Currently in the state of Georgia, if you are filing a claim against your Underinsured Motorist coverage on your car, any money you received from the at fault party is subtracted from your available money from your policy coverages. So if your policy uninsured motorist bodily injury limit was $50,000 and you incurred hospital bills in excess of $200,000, if the other party had only $25,000 in bodily injury, then your policy would only pay $25,000 towards your medical bills. Effective January 1, 2009, the law changes regarding the Underinsured Motorist Coverage. You can buy Add On Uninsured Motorist or Reduced Uninsured Motorist coverages. Reduced Uninsured Motorist Coverage would continue to cover you as the law does currently. Add On coverage extends the payout for Under Insured Bodily Injury / Property Damage to no longer factor out any funds received from the at fault party. All carriers will begin sending out forms with January renewals notifying you of the changes. Some of our carriers, Mercury and Allied for example, will be increasing your Uninsured Motorist coverage to meet the new law requirements, unless you contact them and sign the necessary form to keep the current coverage you have. Some of our carriers, Travelers for example, will be renewing policies without increasing the coverage and will allow you 5 days from renewal to sign the necessary forms to indicate your choice before they increase the Uninsured Motorist to comply with the new laws.
The change in the law will affect the Uninsured Motorist portion of the premium only. The forms are lengthy and a bit confusing so, if you have questions, call us for further explanation.
